Certain recent experiments are often taken to show that people are far more likely to classify a foreseen side-effect of an action as intentional when that side-effect has some negative normative valence. While there is some disagreement over the details, there is broad consensus among experimental philosophers that this is the finding. We challenge this consensus by presenting an alternative interpretation of the experiments, according to which they show that a side-effect is classified as intentional only if the agent considered (...) its relative importance when deciding on the action. We present two new experiments whose results can be explained by our hypothesis but not by any version of the consensus view. In the course of doing so, we develop a methodological critique of the previous literature on this topic and draw from it lessons for future experimental philosophy research. (shrink)

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. In the opening lines of ‘Black Orpheus’, written as a preface to an anthology of negritude poetry, Sartre challenges white readers ‘to feel, as I do, the shock of being seen’. Reading this poetry, he thinks, should undermine white people’s presumption of the objectivity of their perspective. Accordingly, the essay itself contradicts two prominent aspects of the philosophy he had so far developed: the idea that poetry could not be politically engaged; and the theory of radical freedom. These changes are (...) ultimately rooted in his realisation, upon reading this poetry, that his previous understanding of prose is mistaken. This has the consequence that his philosophical method, which derives ontological conclusions from prose descriptions of experience, has two important limitations: its premises cannot be drawn solely from his own experience; and French prose might be insufficient for formulating all relevant premises. He therefore revises his method to deploy this poetry as phenomenological grounds for ontological conclusions, which transforms his ontology of human existence to include cultural inheritance as a primary feature. We will see how this reading of negritude poetry exemplifies both the epistemic challenge involved in what he calls ‘the look’ and the use of listening in response to it. (shrink)

The search for mechanisms has been a common practice in scientific research. However, since the empiricist critique of causality, and especially during the second third of the twentieth century, other non-mechanistic perspectives—especially deductivism—gained predominance. But the sustained effort of authors such as Michael Scriven, Mario Bunge and especially Wesley Salmon contributed to restoring the respectability of causality and mechanisms in philosophy of science. Some members of the causal family, usually lumped under the name of “new mechanistic philosophy”, emphasize the description (...) of mechanisms, especially causal ones, as a central aspect of explanation and other research practices in several areas of science. This approach offers viable solutions to the various ontological and methodological objections that are opposed to the two traditional approaches. In this work the basic characteristics of three philosophies that highlight the description of mechanisms as a central element to explanation and their suitability for the science of ecology are discussed. Critical studies in higher education often embrace the ideas of the slowness movement to address time pressure. However, this desirable horizon presents some limitations. On the one hand, by emphasizing solutions at the individual level, boosting slowness may promote tactics incapable of producing changes to the underlying structural dynamics of time pressure. On the other hand, approaches based on slowness may also inadvertently foster a form of ethical paternalism within the context of ethical pluralism by prescribing substantive models of practice (...) ultimately based on ‘do this quickly or do it slowly.’ This theoretical research moves away from the temporal paradigm to that of the way of relating. Building upon the ethical concept of resonance, the approach focuses on a formal critique of the current socioeconomic and ethical dynamics of social acceleration, growth, and innovation that can contribute to projecting non-alienated relationships in higher education. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. Clinical ethics consultation has become an important resource, but unlike other health care disciplines, it has no accreditation or accepted curriculum for training programs, no standards for practice, and no way to measure effectiveness. The Clinical Ethics Credentialing Project was launched to pilot‐test approaches to train, credential, privilege, and evaluate consultants.

This paper examines how digital technologies might be used to improve ethical attitudes towards nonhuman animals, by exploring the case study of nonhuman apes kept in modern zoos. The paper describes and employs a socio-ethical framework for undermining anti-ape prejudice advanced by philosopher Edouard Machery which draws on classic anti-racism strategies from the social sciences. We also discuss how digital technologies might be designed and deployed to enable and enhance rather than impede the three anti-prejudice strategies of contact and interaction, (...) enlightenment, and individualization. In doing so, the paper illuminates the broad potential and limitations of digital technology to both harm and benefit animals via its effects on human ethical attitudes. This examination provides guidance for future projects and empirical work on using digital technologies to promote moral respect for a range of nonhuman animals in different settings. (shrink)

Scientific understanding is a fundamental goal of science. However, there is currently no good way to measure the scientific understanding of agents, whether these be humans or Artificial Intelligence systems. Without a clear benchmark, it is challenging to evaluate and compare different levels of scientific understanding. In this paper, we propose a framework to create a benchmark for scientific understanding, utilizing tools from philosophy of science. We adopt a behavioral conception of understanding, according to which genuine understanding should be recognized (...) as an ability to perform certain tasks. We extend this notion of scientific understanding by considering a set of questions that gauge different levels of scientific understanding, covering information retrieval, the capability to arrange information to produce an explanation, and the ability to infer how things would be different under different circumstances. We suggest building a Scientific Understanding Benchmark (SUB), formed by a set of these tests, allowing for the evaluation and comparison of scientific understanding. Benchmarking plays a crucial role in establishing trust, ensuring quality control, and providing a basis for performance evaluation. By aligning machine and human scientific understanding we can improve their utility, ultimately advancing scientific understanding and helping to discover new insights within machines. (shrink)

El presente artículo estudia las representaciones de mujeres con VIH/sida, en el libro Tiempos del SIDA. Relatos de la vida real, de Myriam Francis. El trabajo inicia con un análisis sobre la exclusión de los sujetos femeninos de la literatura “seropositiva” latinoamericana. Se plantea que las pocas representaciones que existen se enfocan en “mujeres sospechosas”, lo cual se repite, hasta cierto punto, en los textos de Francis seleccionados: “La última puerta”, “La viuda alegre” y “La chica alegre”. Luego, se ofrece (...) una explicación sobre el contexto en el que surgen las historias, un “pabellón-moridero” que se describe más bien como un espacio ameno, el cual, sin embargo, enfatiza la tragicidad que rodea a cada “caso”. Después, se estudian los tres relatos mencionados, en los que se mueven los símbolos primarios del mal (la mancilla, el pecado y la culpabilidad), de manera que una mujer es representada como una “víctima inocente” y otras, como “víctimas culpables” (fundamentalmente por sus “estilos de vida nocivos”). Finalmente, el trabajo concluye que la narrativa de Francis moviliza algunos principios de la “teoría de la degeneración”, para explicar las situaciones experimentadas por los personajes femeninos y ofrecer un mensaje didáctico-moralizante. Feminist reflections on the sexual division of labour have given rise to a body of knowledge on the ethics of care from different disciplines, including philosophy, in which outstanding contributions to the topic have been formulated. This approach is applicable to the analysis of any phenomenon and particularly that of disasters. As various investigations have highlighted, the consequences on the population throughout all of a disaster’s phases (prevention, emergency, and reconstruction) require an analysis of differentiated vulnerabilities based on gender and (...) other identity categories, such as social class, ethnicity, age, disability, sexual identity, etc. The interrelation between all these variables gives rise to differentiated impacts that cannot be ignored in catastrophic contexts, where survival and sustaining life are at stake, so care becomes a central issue. Research on the topic has also identified that, along with the analysis of social vulnerability, we must consider the capacity for agency, both individual and collective, where care is once again of vital importance. Considering the gender approach and its multiple intersections is thus a fundamental theoretical-practical proposal for the study of disasters from philosophy, as it implies an unavoidable epistemic, ontological, and ethical reflection in the face of risk reduction. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

The scholars who defend or dispute moral relativism, the idea that a moral principle cannot be applied to people whose culture does not accept it, have concerned themselves with either the philosophical or anthropological aspects of relativism. This study, shows that in order to arrive at a definitive appraisal of moral relativism, it is necessary to understand and investigate both its anthropological and philosophical aspects. Carefully examining the arguments for and against moral relativism, Cook exposes not only that anthropologists have (...) failed in their attempt to support relativism with evidence of cultural differences, but that moral absolutists have been equally unsuccessful in their attempts to refute it. He argues that these conflicting positions are both guilty of an artificial and unrealistic view of morality and proposes a more subtle and complex account of morality. (shrink)

Cortical stimulation has been used for brain mapping for over a century, and a standard assumption is that stimulation interferes with task execution due to local effects at the stimulation site. Stimulation can however produce afterdischarges which interfere with functional localization and can lead to unwanted seizures. We previously showed that cognitive effort can terminate these afterdischarges, when termination thus occurs, there are electrocorticography changes throughout the cortex, not just at sites with afterdischarges or sites thought functionally important for the (...) cognitive task used, and thresholds for afterdischarges and functional responses can change among stimulation trials. We here show that afterdischarge termination can occur prior to overt performance of the cognitive tasks used to terminate them. These findings, taken together, demonstrate that task-related brain changes are not limited to one or a group of functional regions or a specific network, and not limited to the time directly surrounding overt task execution. Discrete locations, networks and times importantly underpin clinical behaviors. However, brain activity that is diffuse in location and extended in time also affect task execution and can affect brain mapping. This may in part reflect fluctuating levels of attention, engagement, or motivation during testing. (shrink)

This paper is intended to contribute to the discussion of the differential level of adoption of Big Data among research communities. Recognising the impracticality of conducting an audit across all forms and uses of Big Data, we have restricted our enquiry to one very specific form of Big Data, namely general purpose taxonomies, of which Mosaic, Acorn and Origins are examples, that rely on data from a variety of Big Data feeds. The intention of these taxonomies is to enable the (...) records of consumers and citizens held on Big Data datasets to be coded according to type of residential neighbourhood or ethno-cultural heritage without any use of questionnaires. Based on our respective experience in the academic social sciences, in government and in the design and marketing of these taxonomies, we identify the features of these classifications which appear to render them attractive or problematic to different categories of potential user or researcher depending on how the relationship is conceived. We conclude by identifying seven classifications of user or potential user who, on account of their background, current position and future career expectations, tend to respond in different ways to the opportunity to adopt these generic systems as aids for understanding social processes. Ethical dilemmas affect several essential elements of humanitarian aid, such as the adequate selection of crises to which to provide aid and a selection of beneficiaries based on needs and not political or geostrategic criteria. Other challenges encompass maintaining neutrality against aggressors, deciding whether to collaborate with governments that violate human rights, and managing the allocation and prioritization of limited resources. Additionally, issues arise concerning the safety and protection of aid recipients, the need for cultural and political sensitivity, and recognition (...) of the importance of local knowledge, skills, and capacity. The appropriateness, sustainability, and long-term impact of actions; security risks for aid personnel; and the need for transparency and accountability are also crucial. Furthermore, humanitarian workers face the duty to report and engage in civil activism in response to human rights violations and the erosion of respect for international humanitarian law. Lastly, the rights of affected groups and local communities in the decision-making and implementation of humanitarian aid are vital. The traditional foundations and approaches of humanitarian aid appear insufficient in today’s landscape of disasters and crises, which are increasingly complex and divergent, marked by a diminished capacity and shifting roles of various actors in alleviating suffering. This article reviews the historical evolution of the conceptualization of humanitarian aid and addresses some of its ethical challenges and dilemmas. (shrink)

El presente artículo pretende analizar los efectos transformadores que la pandemia por Covid-19 ha obrado en nuestras existencias individuales y en nuestra convivencia social cotidiana desde la propuesta analítica del filósofo surcoreano Byung Chul-Han. Dicha transformación es de tal profundidad que, para nuestro autor, viene a exacerbar los males de la sociedad contemporánea, como el agotamiento y el cansancio por autoexplotación y permanente optimización de sí mismo propiciados por el neoliberalismo globalizado y omnipresente en Occidente. Desde esta constatación analizaremos en (...) particular cómo la prevalencia de la comunicación digital obligada por la emergencia viral trae consecuencias antropológicas que amenazan con eliminar lo esencial de la vida humana: la construcción de rituales, la estructura temporal cotidiana, el contacto corporal con los demás, la pertenencia a una comunidad y la apreciación de lo real en su genuina dimensión ontológica. Finalmente, exploraremos una posible salida a la alienación virtual en que forzadamente se encuentra la sociedad contemporánea. (shrink)

Research clearly shows that increasing the number of women in leadership positions yields financial benefits for the organization. Despite this, there has been limited upward movement in the percentage of women in senior leadership positions. Few studies have examined the linkage between masculine culture and the implications for men. Using a mixed methods approach with two studies, this research focused on four aspects of masculine contest cultural norms and how they impact male identity and perceptions of career advancement. Study 1 (...) used a qualitative interview study of 10 male executives and found that masculine contest culture norms were evident but were being perpetuated and reinforced by organizational culture instead of individual masculine identities. In addition, Study 1 demonstrated a shift in masculine contest culture norms reducing the emphasis on the strong male archetype. Study 2 examines the relationship between masculine contest culture attributes impacting perceived opportunities for career development and promotion. We evaluated these relationships through a large‐scale survey study and found that at higher levels of masculine contest culture norms, men's perceptions of procedural justice for career development and promotion were lower compared with women. Broadly, the findings suggest that masculine archetypes of leadership negatively affect men and women. (shrink)

Automaticity is rapid and effortless cognition that operates without conscious awareness or deliberative control. An action is virtuous to the degree that it meets the requirements of the ethical virtues in the circumstances. What contribution does automaticity make to the ethical virtue of an action? How far is the automaticity discussed by virtue ethicists consonant with, or even supported by, the findings of empirical psychology? We argue that the automaticity of virtuous action is automaticity not of skill, but of motivation. (...) Automatic motivations that contribute to the virtuousness of an action include not only those that initiate action, but also those that modify action and those that initiate and shape deliberation. We then argue that both goal psychology and attitude psychology can provide the cognitive architecture of this automatic motivation. Since goals are essentially directed towards the agent’s own action whereas attitudes are not, we argue that goals might underpin some virtues while attitudes underpin others. We conclude that consideration of the cognitive architecture of ethical virtue ought to engage with both areas of empirical psychology and should be careful to distinguish among ethical virtues. Coherentists fail to distinguish between the individual revision of a conviction and the intersubjective revision of a rule. This paper fills this gap. A conviction is a norm that, according to an individual, ought to be ascribed to a provision. By contrast, a rule is a judicially ascribed norm that controls a case and is protected by the formal principles of competence, certainty, and equality. A revision of a rule is the invalidation or modification such a judicially ascribed norm, provided (...) that the judge meets the burden of argumentation of formal principles. Thus, judges can revise their convictions without changing the law. (shrink)

The question—what is a political constitution?—might seem, at first blush, fairly innocuous. At one level, the idea of a political constitution seems fairly well settled, at least insofar as most political constitutionalists subscribe to a similar set of commitments, arguments and assumptions. At a second, more reflective level, however, there remains some doubt whether a political constitution purports to be a descriptive or normative account of a real world constitution, such as Britain’s. By exploring the idea of a political constitution (...) as differently articulated by J.A.G. Griffith, Adam Tomkins and Richard Bellamy, this essay explores why the normativity of a political constitution may be indistinct and ill-defined, and how compelling reasons for this indistinctness and ill-definition are to be found in the very idea of a political constitution itself. A political constitution is here conceived as a ‘model’ which supplies an explanatory framework within which to make sense of our constitutional self-understandings. The discipline of thinking in terms of a model opens up a critical space wherein there need not be some stark, all-encompassing choice between constitutional models, which, in turn, allows for more subtle understandings of Britain’s constitution as neither exclusively ‘political’ nor ‘legal’. The problem of the limits of science — of the “barriers” and the “confines” — requires a new analysis, which is the task of this book. The issue is considered from the perspective of science as a human activity.

Character plays a central role in our everyday understanding and evaluation of ourselves and one another. It informs the expectations that ground our plans and projects, our moral responses to other people's behaviour and to opportunities we ourselves face, and our political decisions concerning formal education, criminal punishment, and other aspects of social organisation. These philosophical essays clarify this idea of character, analyse its relation with the findings of experimental psychology, and draw out the implications of this for education and (...) for criminal punishment. They emphasise that character is inherently dynamic, challenging the tendency among personality psychologists and virtue ethicists alike to focus on static snapshots of traits, and they emphasise the close integration of character with the individual's social context. The volume is intended to demonstrate the deep conceptual affinity of moral philosophy and social psychology and the consequent potential for each to benefit from the other. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)
